Privacy Policy

This Privacy Policy  (this “Privacy Policy”) is a legally binding contract by and between Cherry Picking Enterprises, LLC, d/b/a Willowfinch, a Washington state limited liability company (“us”, “we”, “our”, or the “Company”) and you as a user of the products and/or services offered by us through the website located at www.willowfinch.com (the “Site”) or application(s) made available for download on your mobile device (the “App”), other related products, applications, or services, and any content made available therein (the “Content”, together with the App and the Site, the “Services”). This Privacy Policy governs our practices and policies regarding the collection, storage, transfer, and use of potentially personally identifiable information (“PII”).

Agreement and Updates

Agreement to Privacy Policy. By accessing, downloading, installing, or otherwise using the Services, you thereby understand, agree, and consent to the privacy practices embodied in this Privacy Policy.

Privacy Policy Updates. We may modify this Privacy Policy from time to time, in our sole discretion, with or without notice direct notice to you. Continued access, installation, or use of the Services constitutes your agreement to such modifications and to be bound by an updated version of this Privacy Policy.

Terms of Service. This Privacy Policy is incorporated into and subject to the terms of our Terms of Service, available at willowfinch.com/terms-of-service, which together forms the complete and full agreement and understanding between you and us regarding your use of the Services.

Collection and use of information

User Information. From time to time we may collect a variety of user information. For example, we may collect your name, email address, payment information, or other user or account details as needed to provide the Services.

Marketing and Advertisements. In the event we use your information for marketing or advertising purposes, you will have the option to opt-out of such use. Opt-out procedures may be found under your Account, within marketing communications, or through third party vendors such as Google, through Google Ads Settings, available at https://www.google.com/ads/preferences.

Use Analytics and IP Addresses. We may use various analytics providers to assess the Service, such as to assess performance and usage. This may incidentally collect various usage data, such as: (a) Internet Protocol (IP) addresses for systems administration, troubleshooting, security, and to prevent prohibited activity; (b) browser or device type; (c) page views; or (d) time spent on page. Data Aggregation. By using the Services you consent that we may aggregate data without PII, and use such information for commercial or non-commercial purposes.

We use cookies to help us identify users, usage, privileges, and preferences. If you do not wish to allow cookies, you can update your browser preferences to “Refuse Cookies” before using the Services.

Feedback. If you submit any feedback, comments, suggestions, or support requests on or through the Services (“Feedback”), you thereby waive any privacy right thereto.

Privacy of Minors. We do not promote or offer the Services to anyone under the age of 13, or the applicable age of minority. If you believe that a minor has disclosed PII on or through the Services please contact us immediately.

Information Disclosure

We value your privacy, and we take reasonable steps to protect and prevent the unauthorized disclosure of PII, however we may disclose such information on an as needed or required basis, provided such disclosure will be done with the recipient’s obligation of confidentiality or limited to the extent necessary to carry out the following: (a) to our employees and contractors in order to provide the Services and who are under an obligation of confidentiality; (b) to third parties with your consent to do so; (c) when we believe in good faith that disclosure is necessary to protect our rights, or to protect your safety or the safety of others; (d) in the event we are involved in a merger, acquisition, change of control, or the sale of some or all of our assets; or (e) as required by law such as to comply with a subpoena or court order.

Where applicable we employ reasonable physical, technical, and administrative protections to maintain and provide the Services securely. We cannot guarantee that our security measures will absolutely prevent security breaches.

Third-party service providers

The Services rely on a variety of third-party service providers, such as for hosting, storage, marketing, analytics, payment processing, and security (“Providers”). Each Provider sets forth its own practices for the processing of PII. It is essential for you to read, understand, and consent to such Provider practices before using the Services.

The Services are not intended for use by residents of the European Union or European Economic Area, and such use may result in the transfer of PII outside of your country of residence to jurisdictions that may not have data protection laws as comprehensive or protective as those in your country of residence.
